Richard Donoghue, the U.S. attorney for the Eastern District of New York, told his staff Thursday that he will become the top deputy to Deputy Attorney General Jeffrey A. Rosen.

Donoghue is the second U.S. attorney in New York to leave his post in recent weeks. His former counterpart in Manhattan, Geoffrey Berman, was recently fired after overseeing several investigations that rankled President Donald Trump.

CNN reported that the Department of Justice was considering replacing the U.S. attorney in Brooklyn with an ally of Barr. CNN noted that this particular post “wields significant influence by virtue of its jurisdiction and recently has investigated individuals close to President Donald Trump.”

The push by Barr to install one of his buddies comes after he forced Geoffrey Berman, the U.S. Attorney from the Southern District of New York, out of his position.

As Rachel Maddow pointed out on Thursday, Barr appears to be methodically removing powerful U.S. attorneys connected to investigations that involve Trump.

Republicans are the “Do Nothing” Party

Republicans and Trump are the ones who DO NOTHING except give tax breaks and Welfare handouts to the Wealthy, while DOING NOTHING for average Joe Americans.

The above video exposes how Republicans are hypocrites who engage in, and condone Socialism for the Rich in the form of corporate bails-outs, tax payer funded sports stadiums, farm subsidies (22 billion in 2019 when Trump was President), but harsh “pull yourself by up by your own bootstraps” Capitalism for everyone else.

 

 

 

 

 

Trump occupied most of his time doing nothing except watching TV, eating hamburgers, golfing and attacking perceived enemies on Twitter with “Mean Tweets”.

 

It’s an outrage that Mitch McConnell is the “Majority Leader” when in fact, he represents the “Minority” of Americans in this country. It’s an outrage how much control he has over everything and how he can legally block what the Majority of Americans want.

 

 

The above chart shows some of the legislation Democrats has passed in the House since taking over in 2018. Mitch McConnell has blocked every single one of these.

 

So when Trump says “Do Nothing Democrats”… it’s another LIE added to his over 30,000 existing lies, false and misleading statements (as claimed by fact checkers). Republicans are the ones who “DO NOTHING” for Average Joe Americans

“In the 1850s, there was a political movement called the Know Nothings. They were fundamentally populist, but they also were intensely xenophobic, racist (although they opposed slavery), and anti-Catholic and Irish. Their name derived not from professed ignorance, but because they were instructed to say, “I know nothing,” when asked about their organization. The Know Nothings evolved into The American Party, which had a short life as a major political party.

It would be understandable if you think I’m comparing them to today’s Republican Party. I’m not, because as questionable as their philosophy was, they believed in using government to do something. Today’s Republican Party, by contrast, is the Do Nothing Party, in Washington, in Frankfort, and throughout the country.

When I worked as a Senate staffer in the 1970s, Republicans actually wanted to do things. They wanted to protect the air and water. They wanted to protect consumers. A lot of them aggressively worked to get us out of the Vietnam War. They believed in a limited, but strong federal government that could help make life better and safer for their constituents.

When I arrived in Congress in 2007, Republicans still cared about education and health care, and while we differed on the details and the urgency, most Democrats and Republicans recognized we could frequently work together to pursue a more perfect union.

Then came the Tea Party, and then came Trump, and now the Republican Party doesn’t want to do anything except to keep Democrats, and citizens, from trying to make the country better.

Let’s review the issues facing the country.

On education, the Do Nothing Republicans want to cut federal spending and undermine public education through charter schools. They don’t want to do anything about $1.7 trillion in outstanding student debt.

On health care, the Do Nothing Republicans tried for eight years to repeal the Affordable Care Act without offering an alternative, and the Trump Administration consistently sabotaged the Act, aka Obamacare, through executive action.

On infrastructure, the Do Nothings promised a major initiative and never came up with one, and in fact, opposed a Democratic measure that passed the House.

On immigration reform, the Do Nothings blocked comprehensive reform in 2013, and during the Trump years did everything they could to make immigration more difficult and crueler, while doing nothing to fix our broken system.

On virtually everything else — the climate crisis, voting rights, housing, poverty and food security, pension reform, cybersecurity, big tech, and, of course, gun safety — you name it, the Do Nothings are, and have been, missing in action.

Their record and their attitude as legislators — their first responsibility under Article 1 of the U.S. Constitution — is not just dismal, it’s nonexistent.

I don’t think it’s unfair to conclude that the Do Nothing Republican Party cares about only three things: cutting taxes, eliminating government regulations and filling the federal courts with conservative justices.

Indeed, that’s all they’ve done when they have controlled the White House and Congress.

What could be stronger evidence of their lack of interest in legislating than the fact that they did not even propose a platform at their convention last year?

And that brings me to Mitch McConnell, the leader of Do Nothingism, who refused to bring 400 House-passed bills to a Senate vote over the past two years and calls himself the legislative Grim Reaper. His raison d’être has been to fill the federal courts with young, conservative judges. The critical question is: To what end?

McConnell, the Senate’s top Republican, has built his legacy by blocking Democratic judicial nominees and filling federal court vacancies with young, conservative and sometimes woefully unqualified judges, as if that is an accomplishment in itself. And what could he possibly expect the country to get out of those judges? I would argue that he doesn’t know and doesn’t care; he simply wanted an electoral issue to motivate conservative voters. In other words, it’s just another example of how the Do Nothing Republican Party only wants to be, as in be in power, and not to do, as in do something for the American people”.  By John Yarmuth

Former Republican Secretary of State Colin Powell said Sunday that President Donald Trump has “drifted away” from the Constitution, adding to a growing list of former top military officials who have strongly criticized the President’s response to the nationwide protests surrounding the police killing of George Floyd.

“We have a Constitution. And we have to follow that Constitution. And the President has drifted away from it,” Powell, a retired general who served under President George W. Bush, told CNN’s Jake Tapper on “State of the Union.”
The comments from Powell, the first African American secretary of state and chairman of the Joint Chiefs of Staff, add to a growing list of rebukes made in recent days by former top officials who have expressed discontent with Trump’s strongman approach to the protests sparked by the death of Floyd, a black man who was killed in late May by a white police officer in Minneapolis.

If there’s a precedent for a president inspiring this kind of pushback from the retired brass, I’m not aware of it.

This month’s developments, including the Lafayette Square scandal, led him to believe he had to step up and speak up. As David Freed wrote for The Atlantic yesterday:

“I believe the president is a racist,” he told me. “The statement has to be made.” For a former officer of Sanchez’s rank to openly brand the president a bigot — as he does in a 1,322-word statement on racial injustice — is unprecedented, military historians say.

“The overtly racist comments and discriminatory actions of our current President,” Sanchez wrote, “have convinced me that this administration does not actually view racial diversity as a pillar of American strength, and that it is choosing to actively ignore many elements of our Constitution.”

Freed noted that Sanchez, the retired former commander of U.S. ground forces in Iraq, has become “the first high-ranking military officer to call out the president for racism.”

Sanchez is not, however, alone among retired military leaders condemning Trump. Indeed, his public concerns come just two weeks after retired Adm. Bill McRaven, the former commander of the U.S. Special Operations Command, perhaps best known as the Navy SEAL who oversaw the 2011 raid that killed Osama bin Laden, expressing related criticisms.

“This fall, it’s time for new leadership in this country,” McRaven said, adding, “President Trump has shown he doesn’t have the qualities necessary to be a good commander in chief…. The country needs to move forward without him at the helm.”

As regular readers know, in recent weeks, the public has heard related Trump criticisms from former Secretary of Defense James Mattis and former Secretary of State Colin Powell — who have eight stars on their shoulders between them.

Retired Navy Adm. James Stavridis and retired Navy Adm. Michael Mullen, a former Joint Chiefs of Staff chairman, also spoke out in the wake of the Lafayette Square debacle. Around the same time, the public heard from retired three-star Admiral Joseph Maguire, who worked for Trump as an acting director of National Intelligence, and who publicly aligned himself with the criticisms of Trump levied by Mattis and Mullen.

They were joined by retired Army Gen. Martin Dempsey, a former chairman of the Joint Chiefs of Staff, who also spoke out against Trump’s divisive politics.

The draft order would open the door for the Commerce Department and the Federal Communications Commission to reinterpret the law and allow the Federal Trade Commission to create a tool for users to report bias online.

Legal experts say only congress has the authority to make changes to Section 230 so Trump’s order is unenforceable.

“Under the McConnell amendment, Barr gets to look through the web browsing history of any American—including journalists, politicians, and political rivals—without a warrant, just by saying it is relevant to an investigation,” said Wyden, who has been trying to ban warrantless surveillance on such records.

McConnell’s amendment blocks the FBI from seeking the “content” of web browsing and searching conducted by Americans. Some provisions of the 2001 Patriot Act – which greatly expanded government intelligence gathering in the wake of the 9/11 terrorist attacks – expired this year amid GOP gridlock.

The legislation has drawn criticism over the breadth of surveillance it enables.

The U.S. House reauthorized the three lapsed intelligence programs this March, and the U.S. Senate passed its own version May 14, making changes that sent the bill back to the House. Before final passage, though, the Senate by the narrowest of margins defeated an amendment that would have limited access to internet browser and search histories.

The background

The statement implies this was a vote to enable internet history access without a warrant. The government has actually been able to do that for nearly 20 years.

That was among many powers granted by the 2001 Patriot Act. Section 215 can be used to compel third parties (such as internet service providers) to produce information related to intelligence investigations (not law enforcement investigations).

This has long been considered compatible with the U.S. Constitution’s Fourth Amendment protection against unreasonable search and seizure, since the Supreme Court has said since the 1970s that protection does not apply to records held by third parties, according to Robert Chesney, director of the Robert Strauss Center for International Security and Law at the University of Texas at Austin. He noted this interpretation is now “under pressure,” but still in place.

Section 215 allows government investigators to obtain internet browsing history or search queries, but there are limitations, Chesney said.

For an American, the power may be used only to obtain web history related to a counterterrorism or counterintelligence investigation. (For a foreign national, any foreign-intelligence purpose can justify access to online history.)

The request must be approved by the Foreign Intelligence Surveillance Court, made up of 11 federal judges from around the country. The court was established by Congress through the Foreign Intelligence Surveillance Act of 1978 to approve electronic surveillance, physical search and certain other forms of investigative actions for foreign intelligence purposes.

Earn It Bill… New Threat To Internet Freedom

How a proposed bill to protect children could actually chip away at your privacy

Imagine an Internet where the law required every message sent to be read by government-approved scanning software. Companies that handle such messages wouldn’t be allowed to securely encrypt them, or they’d lose legal protections that allow them to operate.

That’s what the Senate Judiciary Committee has proposed and hopes to pass into law. The so-called EARN IT bill, sponsored by Senators Lindsey Graham (R-SC) and Richard Blumenthal (D-CT), will strip Section 230 protections away from any website that doesn’t follow a list of “best practices,” meaning those sites can be sued into bankruptcy. The “best practices” list will be created by a government commission, headed by Attorney General Barr, who has made it very clear he would like to ban encryption, and guarantee law enforcement “legal access” to any digital message.

 

The EARN IT bill had its first hearing today, and its supporters’ strategy is clear. Because they didn’t put the word “encryption” in the bill, they’re going to insist it doesn’t affect encryption.

This bill says nothing about encryption,” co-sponsor Sen. Blumenthal said at a hearing. “Have you found a word in this bill about encryption?” he asked one witness.

It’s true that the bill’s authors avoided using that word. But they did propose legislation that enables an all-out assault on encryption. It would create a 19-person commission that’s completely controlled by the Attorney General and law enforcement agencies. And, at the hearing, a Vice-President at the National Center for Missing and Exploited Children (NCMEC) made it clear [PDF] what he wants the best practices to be. NCMEC believes online services should be made to screen their messages for material that NCMEC considers abusive; use screening technology approved by NCMEC and law enforcement; report what they find in the messages to NCMEC; and be held legally responsible for the content of messages sent by others.

You can’t have an Internet where messages are screened en masse, and also have end-to-end encryption any more than you can create backdoors that can only be used by the good guys. The two are mutually exclusive. Concepts like “client-side scanning” aren’t a clever route around this; such scanning is just another way to break end-to-end encryption. Either the message remains private to everyone but its recipients, or it’s available to others.

The 19-person draft commission isn’t any better than the 15-person commission envisioned in an early draft of the bill. It’s completely dominated by law enforcement and allied groups like NCMEC. Not only will those groups have a majority of votes on the commission, but the bill gives Attorney General Barr the power to veto or approve the list of best practices. Even if other commission members do disagree with law enforcement, Barr’s veto power will put him in a position to strongarm them.

Whistleblower delivers damning testimony on Trump response

Rick Bright, senior advisor with the National Institutes of Health, warned there’s still not enough testing capability in the US. “The virus is still spreading everywhere,” Bright told the House Energy and Commerce Committee hearing.

Bright was ousted last month as director of the Biomedical Advanced Research and Development Authority, a government agency that procures vaccines for the national stockpile. Bright claims his ouster was retaliation for his criticism of the Trump administration’s handling of the pandemic, including Trump’s touting of the drug hydroxychloroquine.

“There were some attempts to bypass that rigorous vetting process that caused me great concern,” Bright testified. But Health and Human Services Secretary Alex Azar slammed Bright’s claims, saying he “literally signed” the application for FDA authorization of hydroxychloroquine.
